不是说超过8小时就算加班的,要看单位与员工约定的是何种工时制度。
标准工时制的话超过8小时要支付加班费,不支付就是违反劳动法。综合计算工时制的话要综合一定周期员工总的工作时间,看是否超过法定标准,单纯的一两天超8小时不算加班。不定时工时制一般适用于高管,就更灵活了。当然后两种工时制要在劳动部门备案。It doesn’t mean that working overtime is considered overtime if it’s more than 8 hours. It depends on what kind of working hours system the company and the employee have agreed upon.
In the standard working hours system, overtime pay must be paid if the hours exceed 8 hours. Not paying overtime is a violation of the labor law. In the comprehensive working hours system, the total working hours of employees in a certain period must be considered to see if it exceeds the legal standard. Simply working over 8 hours for one or two days does not count as overtime. The irregular working hours system is generally applicable to senior executives and is more flexible. Of course, the latter two working hours systems must be filed with the labor department.
