离职了没有年终奖
对于已经明确制定规章制度规定年终奖在离职后不予发放的企业来讲,分为两种情形:
一是劳动者在做满一年后离开公司,这时年终奖的考核依据已经确定,只是在实际计核和发放时员工已离开公司;
二是劳动者在公司没有做满一年,其年终奖的请求主要是按照一年业绩的月份比例来比照。对于这两种情形,前一情形劳动者要求企业支付年终奖得到仲裁认可的可能性大于后者。
No year-end bonus after leaving
For companies that have clearly formulated rules and regulations stipulating that year-end bonuses will not be paid after leaving, there are two situations:
One is that the employee leaves the company after working for a full year. At this time, the assessment basis for the year-end bonus has been determined, but the employee has left the company when the actual calculation and payment are made;
The second is that the employee has not worked for the company for a full year, and his request for a year-end bonus is mainly based on the monthly ratio of the annual performance. For these two situations, the former situation is more likely to be recognized by arbitration when the employee asks the company to pay the year-end bonus than the latter.
You will not get your year-end bonus after you leave the company, unless you leave after receiving the year-end bonus
