《淘宝规则》-违背承诺:
(三)卖家违背以下任一承诺的,需向买家支付该商品实际成交金额的5%作为违约金,且金额最低不少于1元,最高不超过30元;买家发起投诉后卖家未在淘宝网人工介入且判定投诉成立前主动支付该违约金的,除须赔偿违约金外,每次扣3分。
1、除特殊情形外,买家付款后,卖家未按约定的发货时间发货的(交易双方另有约定的除外);
二、试运行方案:
若卖家出现上述违规情形,且在淘宝网人工介入判定投诉成立前主动支付违约金达第3次及3次的倍数时,淘宝将按照累犯从重原则,在卖家支付该违约金的同时,给予一般违规扣分扣3分的处理(但三天内累计扣分不超过12分)。
例如:卖家多次出现“未按约定发货时间发货”情形,且均在淘宝网人工介入且判定投诉成立前主动支付了违约金,第一次不扣分,第二次不扣分,第三次将在支付违约金的基础上给予一般违规扣分扣3分; 第四次不扣分,第五次不扣分,第六次在支付违约金的基础上给予一般违规扣分扣3分,以此类推!
Taobao Rules - Breach of Promise:
(III) If a seller violates any of the following promises, he shall pay the buyer 5% of the actual transaction amount of the product as liquidated damages, and the minimum amount shall not be less than 1 yuan and the maximum amount shall not exceed 30 yuan; if the seller does not actively pay the liquidated damages before Taobao intervenes manually and the complaint is determined to be established after the buyer initiates the complaint, in addition to paying the liquidated damages, 3 points will be deducted each time.
1. Except for special circumstances, after the buyer pays, the seller fails to ship the goods on the agreed delivery time (unless otherwise agreed by the transaction parties);
II. Trial Operation Plan:
If the seller violates the above-mentioned regulations and actively pays the liquidated damages for the third time and multiples of the third time before Taobao intervenes manually and determines that the complaint is established, Taobao will, in accordance with the principle of heavier punishment for recidivism, deduct 3 points for general violations while the seller pays the liquidated damages (but the cumulative deduction within three days shall not exceed 12 points).
For example: if the seller fails to deliver the goods on time as agreed many times, and has paid the penalty before Taobao intervenes manually and determines that the complaint is established, no points will be deducted for the first time, no points will be deducted for the second time, and 3 points will be deducted for the third time on the basis of the payment of penalty; no points will be deducted for the fourth time, no points will be deducted for the fifth time, and 3 points will be deducted for the sixth time on the basis of the payment of penalty, and so on!
Once a complaint is filed successfully, the product will be forcibly removed from the shelves by the system. In serious cases, the store will be deducted points and downgraded. This will reduce traffic and affect business for a period of time in the future. If it involves selling counterfeit goods, the store may be closed down.
