There are mainly the following differences between a labor contract and an agency contract:

1. A labor contract basically has only two parties, one is the employer, and the other is the labor provider. However, in an agency contract, the Civil Code changes it to an intermediary contract, and there are three parties involved, the demander, the intermediary, and the party that meets the demand.

2. A labor contract can stipulate the labor term, and the labor fee can be paid in installments according to the agreement. However, the agency fee is generally paid in one lump sum.
